Case 2. ? James Wragg was next arraigned for stealing a lamb, the property of Mr. Machattie, his master. On the indictment being read, and the prisoner being about to be given in charge to the jury, the Judge interposed. Stop; let me see the indictment. Are you defended by counsel? Prisoner, No. Then withdraw your plea for the present. The Judge remarked : I have some doubts as to the indictment being so formed that we have any jurisdiction in this matter. The prisoner is indicted for stealing a lamb. This offence was formerly capital, under the statue of 2 and 3 Wiiliam TV. c. 62; but 9. Geo. IV. c. 65. enacted amongst other things, that any person stealing horse, mare, gelding, colt, or filly, bull cow, or steer, bullock, heifer, or colt, or any ram, ewe, sheep, or lamb, and being convicted, shall be transported for the term of his natural life. By the Ist Vie. c. 91. the punishment is commuted to transportation for fifteen years, or imprisonment for a term not exceeding three years. Then we cannot proceed. It is not in our jurisdiction ; but it must be tried in the Supreme Court. The indicment had better be withdrawn, and the -prisoner indicted for embezzleing his master's property. The Sheriff remarked to his Honor, he was so directed to be committed. The indictment was prepared according to the form suggested by the Judge, and the prisoner was given in charge to the Jury. The Crown Prosecutor addressed the Court, and said ? It appeared the prisoner had already suffered one month's imprisonment; and as the man was drunk, and from the nature of the evidence, some doubts might arise a3 to the converting the property to his own use, he would decline calling any witnesses. The Judge, ? Gentlemen of the Jury, there heiug no evidence, it will be your duty to acquit the prisoner. ? Verdict, Nor Guilty.

Elizabeth Parr

Campbell Island was discovered in 1810 as the result of a search for new islands where unmolested seal herds might exist. The discoverer was Captain F. Hassclbourgh, in the brig Perseverance, representing Campbell and Company, of Sydney. After returning to Stewart Island to report his discovery to his principals and to pick up men and stores. Captain Hasselbourgh returned to Campbell Island, and soon afterwards he was accidentally drowned. On November 4, 1810. he went down Perseverance Harbour to visit a gang of men he had working near the entrance, and his small boat was capsized in a sudden squall. Woman?s Grave At the time he was accompanied by Elizabeth Parr, of the Norfolk Island penal settlement, and three men and a boy. Apart from the captain, another man and Miss Parr were drowned?and only her body was recovered. It was not unknown for women to travel on sealing vessels: in 1838 the Rev. J. Wilkinson wrote that native women sometimes went to sea or were bribed to do so. , "Similar traffic appears to have been carried on in Sydney among European females. Convict women desirous of leaving the settlement were especially addicted to this method of effecting their escape." he wrote. "Traces of Elizabeth Parr's burial plot are still extant on the south-west arm of Perseverance Harbour. It was reputed to be the grave of a Frenchwoman, arising, no doubt, from the fact that the officer of a French expeditionary ship lost his life in the harbour, and is buried not far from the grave of the other.? The tale of the ?Frenchwoman? is so far-fetched that it is worth recording again as an exercise in Pacific fantasy which had a credulous following.
