COUNTY COURT, WELLINGTON.
TUESDAY, JULY 19. 4TH SESSION.
Anthony Dunlop, indicted for stealing two boards, value four shillings, the property of Robert Jenkins.
B: Eglington, sworn. ? I am a constable ; on the 11th instant, towards daybreak, I was going my rounds, I saw a man passing in front of Mr. Wade's store, he turned up Farish-street, I pursued him ; he was carrying some boards under his arm, I overtook him at the corner of Manners-street and the corner of Willis-street, near Mr. Wilson's fence. I took hold of him and asked where he got that wood from, he said it belonged Œto himself, he struggled to escape and eventtually he got loose ; he dropped the boards, he ran down towards a house which I afterwards found to be that of the prisoner ; at the door he went into- the part of the house which is unfinished, he shut the door as he went in ; I ran round to the front of the house, I found he had made his escape, I did not see him afterwards ; I placed a person in front of the house to watch, and searched that part of the house which is unfinished. I then went round to the back door and tried to get admittance. Soon after, the prisoner at the bar, came up to me. Mr. Crawford then came up, the prisoner being present and told me he suspected the prisoner knew something of it ? that he had seen the prisoner come along the street in the same direction from Manner'srstreet, and had asked him what was the^m'atte'r, I asked the prisoner if the house' belonged to him, he said yes ; I said I must search the house ; I said that I suspected that a man whom I had detected in committing a felony was concealed in the house. After a little while he went round to the front door, and entered the house, opened the back door, and let me in. I searched the house and found no one.
